About the EB-5 Investor Visa Program
The EB-5 (Employment Based Fifth Preference Category) is for immigrant investors who wish to manage a business in the United States in exchange for lawful permanent residency. Only 10,000 EB-5 investor green cards are available each year.
There are two distinct ways to obtain an EB-5 visa: The Basic Program and the Regional Center Pilot Program. The Basic Program enables immigrants to invest in their own business or a business owned by other parties, while the Regional Center Pilot Program enables them to invest in “regional centers” that are approved by government entities.
As of November 2019, both programs require immigrants to make either a $800,000 investment into a new or existing U.S. business that is located in a rural area or an area with a high unemployment rate or a $1,050,000 investment in a new or existing U.S. business. Investors are responsible for creating at least ten new full-time jobs. Investors can recover their investment, but only if the business is still running for at least two years (in order to fulfill conditional permanent residency).
